Terms of Service

1. Agreement

These terms are an agreement between you and Avacod s.r.o., a company registered in Slovakia, [registered office and company ID to be inserted] ("we", "us"), which operates the GuardMessage app and service. By creating an account you accept these terms. If you do not accept them, do not use the service.

How we handle personal data is described in our Privacy Policy, which forms part of this agreement.

2. What GuardMessage is — and is not

GuardMessage lets you store a message, choose trusted contacts ("guardians") and set a check-in deadline. If you do not check in before the deadline, our servers attempt to send your guardians a link to that message.

GuardMessage is not an emergency service. It does not contact police, ambulance, mountain rescue or any other authority, and nobody at our company monitors your switches. In an emergency, call your local emergency number.

Do not rely on GuardMessage as your only safeguard where someone's life or health depends on a message arriving.

Delivery depends on things outside our control — mobile networks, e-mail providers, spam filtering, your guardian's phone, and the contact details you entered. We make a genuine effort to deliver and to retry, but we cannot and do not guarantee that any message will arrive, arrive on time, or be read.

3. Eligibility

You must be at least 18 years old and able to enter into a binding agreement.

4. Your account

You are responsible for keeping access to your e-mail account, your devices and your sign-in methods secure, because these are what protect your account. Tell us promptly at support@guardmessage.com if you believe someone else has gained access.

You are responsible for keeping your own contact details and your guardians' contact details correct and current. A message cannot reach a number or address that is wrong or no longer in use.

5. Guardians and other people's data

When you add a guardian you give us their phone number or e-mail address. You confirm that you are entitled to provide those details and that it is reasonable for that person to be contacted by us on your behalf. We will notify them that you added them, so they are not surprised later, and they can decline the role.

Do not use guardian notifications to contact people who do not want to hear from you.

6. Acceptable use

You must not use GuardMessage to:

  • store or send content that is illegal, or that infringes someone else's rights;
  • harass, threaten or deceive anyone, including through guardian notifications;
  • send unsolicited messages, or repeatedly trigger sends in a way that runs up our messaging costs;
  • attempt to access other users' data, probe or disrupt the service, or bypass its security or usage limits;
  • use the service in a way that breaks the law where you are.

We may suspend or close an account that breaches these rules, and where the breach is serious we may do so without notice.

7. Beta

GuardMessage is currently offered as a private beta to a limited group of testers. During the beta the service may change, be interrupted, or lose data, and features may be added or removed. Please do not use it during the beta as your sole safeguard for anything that matters.

8. Fees

The service is currently free. We intend to introduce a paid tier with additional features. If we do, we will tell you clearly before anything you use starts costing money, and any purchase will be made through the Apple App Store or Google Play under their terms and refund rules.

9. Availability

We aim to keep the service running continuously, but we do not promise uninterrupted availability. We may take the service down for maintenance, and we may change or discontinue features. If we discontinue the service entirely, we will give you reasonable notice and an opportunity to export your data.

10. Liability

The service is provided as it is. To the fullest extent permitted by law, we are not liable for indirect or consequential loss, or for loss arising because a message was not delivered, was delivered late, was delivered to the wrong person because of details you entered, or was read by someone who obtained access to your guardian's device or messages.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. If you are a consumer, your statutory rights are not affected by these terms.

11. Your content

Your messages and files remain yours. You grant us only the limited permission needed to store, encrypt, process and deliver them as you have configured — nothing more. We do not use your content for any other purpose.

12. Ending the agreement

You can stop using the service and delete your account at any time in the app. Deleting your account permanently removes your data as described in the Privacy Policy. We may end this agreement if you materially breach these terms, or if we discontinue the service.

13. Changes to these terms

We may update these terms. We will change the date at the top, and if a change materially affects your rights we will notify you in the app before it takes effect. Continuing to use the service after that means you accept the updated terms.

14. Governing law

These terms are governed by the law of the Slovak Republic, and disputes fall to the courts of the Slovak Republic. If you are a consumer resident in the EU, this does not deprive you of the protection of the mandatory law of your country of residence, and you may also use the EU online dispute resolution platform.
